1. Nature of Service & Digital Advertising Classification

WatchRank is operated by WatchRank Media B.V., a private company registered under the laws of the Netherlands (KVK: 84920194, Amsterdam).

WatchRank is strictly classified as an independent digital media showcase, horological status directory, and commercial advertising service (MCC 7311: Advertising Services). All transactions executed on WatchRank represent fees paid for instant digital placement, spotlight positioning, and social/directory promotional broadcasts.

2. Absolute Disclaimer of Brokerage, Physical Custody & Auctions

WatchRank explicitly disclaims physical watch custody, brokerage, escrow services, physical auctioneering, games of chance, lotteries, and betting:

• No Physical Property Transfer: WatchRank does not buy, sell, warehouse, authenticate in-person, take custody of, or ship physical timepieces. All showcased timepieces remain in the continuous possession of their respective owners.
• No Auctioneering or Escrow: We do not conduct auctions under Dutch Veilingrecht (Burgerlijk Wetboek Boek 7) or act as an escrow agent for watch sales.
• Zero Chance / Non-Gambling: Placements are 100% deterministic based on disclosed advertising sponsorship amounts. No lotteries, random variables, or games of chance are operated on this platform.

3. Dynamic Spotlight Placement & Zero Duration Guarantee

Leaderboard and showcase positions on the WatchRank Concourse are dynamic and non-exclusive. A timepiece holds Rank #1 (The Crown) or any designated rank only as long as another sponsor does not allocate a higher sponsorship tier boost.

WatchRank provides zero guarantee of duration for any specific rank position. Once a placement transaction is completed, immediate digital performance has occurred.

4. Advertiser Obligations & Authentic Imagery

By uploading watch photographs and technical references to WatchRank, you warrant and represent that:

• You own or have full copyright authorization to publish the submitted imagery.
• The photographs depict a genuine timepiece and do not misrepresent reference numbers.
• Submitted content does not violate intellectual property, privacy, or harassment laws.

WatchRank reserves the right to unpublish, redact, or flag listings that violate our quality standards or infringe third-party rights, without refund.

5. Trademark Non-Affiliation

Rolex, Patek Philippe, Audemars Piguet, Richard Mille, Omega, Cartier, and other brand names, trade dress, and trademarks referenced on WatchRank are the intellectual property of their respective brand owners. WatchRank is an independent media platform and is not authorized, endorsed, or affiliated with any watch manufacturer.

6. Governing Law & Jurisdiction

These Terms of Service, along with any advertising service agreements entered into with WatchRank Media B.V., shall be exclusively governed by and construed in accordance with the laws of the Netherlands.

Any dispute, controversy, or claim arising out of or relating to these Terms shall be submitted to the exclusive jurisdiction of the Amsterdam District Court (Rechtbank Amsterdam) in the Netherlands.
